1. GENERAL

1.1

These general terms and conditions ("Terms") apply when you as a consumer ("You" or "Customer") place an order via www.historly.com or www.historly.se, and related pages, ("Home page" or "Site "). Agreement is concluded between you and HISTORLY AB, organization number 559215-5575 ("Historly"). Detailed contact details and other information about Historly can be found on the website. The terms and conditions are only applicable to you who are consumers and who place orders via the Website.

1.2

In order to be able to order on the Website, you must, in accordance with Swedish law, be 18 years of age. When you place an order on the Website, you as a Customer confirm that you are at least 18 years old and legally have the right to place an order on the Website. Historly reserves the right in individual cases to refuse or change your order (for example, if you have provided incorrect personal data and/or have payment objections).

1.3

The website and all its content are owned by Historly, its licensors or other third parties. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written approval from Historly.

2. AGREEMENT AND ORDER

2.1

In order to place an order on the Website, you must accept the Terms and Conditions. By accepting the Terms and Conditions, you undertake to follow the Terms and Conditions in their entirety, as well as agree that you have read the information about personal data and consented to the use of personal data and cookies according to Historly's personal data policy, see here .

2.2

A purchase agreement is only entered into when Historly has confirmed your order and you have received order confirmation from Historly by e-mail. Historly invites you to save this order confirmation for any contacts with Historly's customer service. You can cancel your order until it has been confirmed by Historly. If the order is cancelled, Historly will refund any payments that You or your payment or credit card companies have made regarding the order.

3. CUSTOMER INFORMATION

3.1

When you place an order, you will be asked to enter personal data. You acknowledge and are responsible for the accuracy and completeness of the information you provide. Read about how Historly handles customer information in the personal data policy, see here .

4. PRICES, FEES AND PAYMENT

4.1

The prices stated on the Website are those that apply when you place an order on the Website. The prices listed on the Website include the charge for standard shipping.

VAT is included in the price when you shop from Norway, Sweden and other EU countries, but is not included if you shop from other countries that do not belong to the EU. You are responsible for paying any additional costs, taxes or duties that may apply in your jurisdiction when you place an order on our Website.

4.2

You can pay in the ways indicated on the Website. Read more about Historly's different payment methods here . Historly has the right to charge already in connection with the order, unless invoice payment or a similar payment method has been chosen by you and approved by Historly. In such case, you will be informed about this. Historly reserves the right not to always offer all payment methods, or to change the payment method if the one you chose for some reason does not work at the time of the purchase. Please note that Historly is not responsible for the available payment methods as these are provided by third parties.

4.3

When you place an order on the Website, you confirm that you are legally entitled to use the payment method you have chosen and that, if you pay by card, you are either the cardholder or have the cardholder's express permission to use the card to make the payment on the Website.

5. DELIVERY AND TRANSPORT

5.1

Goods that are in stock are normally delivered within the number of working days specified on the Website. If nothing else has been agreed (for example, when purchasing ordered goods or goods that are not in stock), the delivery will take place within the last 30 working days from the time Historly has confirmed the Customer's order by e-mail via order confirmation. You can find more information about delivery and conditions for it here under the Shipping section.

5.2

The expected delivery time is stated here under the Shipping section, in the checkout and/or on the relevant product page on the Homepage. Unless otherwise agreed, you have the right to cancel the purchase if the delivery is delayed by more than 30 days and it is not caused by you as a customer.

5.3

If a package is to be picked up at a delivery point, you must do this within the time frame specified in the notification. Packages must normally be picked up in person with valid identification and a reference number. The customer will be notified where and when the package is to be picked up. Historly is under no circumstances responsible for any direct or indirect extra costs or expenses that arise due to the Customer, for example as a consequence of the package not being picked up by the Customer in time. Historly has the right to charge the Customer a fee of SEK 250 if the package is not picked up on time.

6. RIGHT OF WITHDRAWAL

6.1

When ordering on the website, a 30-day right of cancellation applies to posters and frames . The right of withdrawal or exchange does not apply to canvas paintings, frames on which you have ordered a framing service, framing service that is carried out in the factory when ordering one, and specially adapted products such as personal posters that are personalized and printed to order. The right of cancellation for other goods means that you have the right to cancel your purchase by notifying Historly of this within 30 days from when you or your representative received the ordered item (the cancellation period).

6.2

Please note that frames come with a protective plastic that must not be opened if you want the right to return a frame. Posters are delivered in a similar way with a sticker over the tissue paper in which it or they are rolled . The sticker must not be opened or broken if you want to be able to exercise your right of withdrawal.

If you want to exercise your right of withdrawal and cancel a purchase, before the withdrawal period has expired, you must send a clear message to Historly at hello@historly.com and tell them this. You must state your name, address and why you wish to make a return. You must also enter other relevant information such as, for example, the order number, the name of the product and the quantity that is desired to be returned.

6.3

The products must be returned within 14 days from when you notified Historly of your wish to cancel your purchase. You as a customer pay SEK 69 for the return shipping (with the exception of 100x140 frames which cost SEK 400 due to the size) when you exercise your right of withdrawal and are responsible for the condition of the products from the time the customer received the item until it was returned and received by Historly again. The goods to be returned must be sent well packaged in their original packaging and in unaltered condition. When you exercise your right of withdrawal, you must follow the instructions for this set out by Historly on the homepage here , under Right of withdrawal and returns .

6.4

When you have exercised your right of withdrawal and returned the goods in unchanged condition, Historly will make a refund of the amount you have paid minus the return shipping of SEK 69 (SEK 400 for 100x140 frames). Any costs for customs duties and the like incurred due to your jurisdiction will not be refunded. Historly is entitled to deduct an amount corresponding to the item's decrease in value compared to the item's original value, if and to the extent that such decrease in value is due to You having handled the item to a greater extent than is necessary to determine its properties or function. Historly applies a full reduction in value (ie the entire value of the item) if the returned item is not in a condition to be resold (such as a new item).

6.5

Historly will make the refund without unreasonable delay once Historly has received the returned goods and confirmed their condition in line with Historly's refund policy, read here under section Right of withdrawal and returns.

7. OTHER WEBSITES

7.1

The website contains links to websites owned by third parties. Historly is not responsible for management, security, content or any other aspect thereof.

8. COMPLAINT

8.1

You have the right to claim a refund or replacement if a product has been damaged, is missing or is subject to a printing error that is not the result of your own actions. All Customers wishing to assert their right to submit a complaint for an ordered product must contact Historly as soon as possible after the error was discovered by sending an e-mail to hello@historly.com. It is important that you examine the products carefully as soon as you have picked them up.

8.2

Historly is responsible for the return shipping for approved complaints

8.4

Historly will normally investigate the right to receive a refund or compensation within 14 working days of receiving such a claim. Historly reserves the right to deny a complaint if it turns out that the product is not faulty according to current consumer protection legislation. 9. FORCE MAJEURE

    9.1

    Historly reserves the right to invoke Force Majeure in situations where this is applicable. Historly is not responsible for delays caused by such circumstances as they are beyond History's control. Examples of situations where Historly can invoke Force Majeure are, for example, extreme weather, acts of war, fire, changed government orders, technical problems and others. Historly is also not responsible for errors or delays of subcontractors arising due to such circumstances. If the situation has lasted for more than two months, both the customer and Historly have the right to terminate the purchase with immediate effect.

    10. CHANGES TO THE TERMS

    10.1

    Historly reserves the right to change these terms and conditions. Any changes to the terms will be posted on the website. Changes will apply when You have accepted the terms (in connection with a new purchase or while browsing the Website), alternatively 30 days after Historly has informed you as a Customer about the changes.

    11. GOVERNING LAW AND DISPUTES

    11.1

    If a dispute arises between you and us (Historly), we strongly encourage you to first contact us directly for resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration.

    In the event of a dispute, we (Historly) follow decisions from ARN ( Allmänna reclamationsnämnden ) or equivalent dispute resolution body.
